Terms of service

Effective 27 September 2026

These terms are an agreement between [Company legal name — set LEGAL_COMPANY_NAME] ("we") and the business or person who uses Wirk ("you"). By creating a workspace or using the service you accept them. If you use it for a company, you confirm you're allowed to accept on its behalf.

The service

Wirk uses AI to help you create content, answer your inbox, plan a content calendar, run ads and automate work, using the accounts you connect. We may improve or change features over time. If we remove something important you pay for, we'll tell you first.

Your account

  • Keep access to your email secure; anyone who can read it can sign in as you.
  • Workspace owners and admins control who is a member and what gets approved. You're responsible for what happens in your workspace.
  • Connect only accounts you're authorised to manage. You must follow the rules of the platforms you connect, such as Meta's and Google's terms and advertising policies.

AI output and approvals

AI can be wrong. Content, replies and campaigns the service drafts are suggestions until an admin in your workspace approves them. You're responsible for reviewing what you approve, including prices, claims, offers and anything sent to your customers. Automatic replies run only if you turn them on, and only within the limits you set.

Ads and spending

Campaigns are created paused. They go live only when an admin approves it, and only within the daily spend cap set for the workspace. Ad platforms bill you directly for your ad spend under their own terms; we don't pay for or refund ad spend.

Acceptable use

Don't use the service to:

  • send spam or unsolicited messages, or break messaging rules such as Meta's 24-hour messaging window;
  • publish content that is illegal, deceptive, hateful or infringes someone else's rights;
  • impersonate others, or collect people's data without a legal basis;
  • get around plan limits, probe or disrupt the service, or reverse-engineer it.

We may suspend a workspace that breaks these rules or puts others at risk. Where we can, we'll tell you first.

Your content

You own what you put in and what the service makes for you, as far as the law allows. You give us permission to host, process and send it only to run the service for you. You confirm you have the rights to material you upload, such as logos, photos and product details.

Plans, credits and payment

  • Paid plans renew each month or year until cancelled. Cancelling takes effect at the end of the paid period, and the plan keeps working until then.
  • Plans include credits that the service uses as you work. Daily and monthly credits don't roll over. Credits you buy as top-ups don't expire while your workspace exists.
  • When you change plans, our payment provider either charges or credits the difference for the rest of the period (Stripe), or starts the new plan straight away and ends the current one (Whop).
  • Payments for plans and credits are processed by Whop or Stripe. Prices don't include tax unless shown otherwise.
  • Fees are non-refundable except where the law requires, or where we decide to refund.
  • If a payment fails, monthly credits stop refilling until it's fixed.

Privacy

Our privacy policy explains how we handle personal data. When you process your customers' data through the service, you are responsible for having a legal basis and telling them as the law requires. We process it only on your instructions.

Ending the agreement

You can stop at any time. A workspace owner can delete the workspace in Settings, which deletes its data (see data deletion). We may end the service for you if you seriously or repeatedly break these terms. If we end it for any other reason, we'll give 30 days' notice and refund prepaid fees for the unused period.

Warranties and liability

The service is provided "as is". We work to keep it available and accurate but don't promise it will be uninterrupted or error-free, or that AI output will be correct. To the extent the law allows, we aren't liable for indirect or consequential losses such as lost profits or data. Our total liability is limited to what you paid us in the 12 months before the claim. Nothing here limits liability that can't be limited by law.

General

These terms are governed by [governing law — set LEGAL_GOVERNING_LAW, e.g. the laws of England and Wales]. If we change them in a material way, we'll tell workspace owners before the change takes effect. Continuing to use the service after that means you accept the new terms.
